After a judge rejected twice their arguments that Attorney General Jerry Brown's ballot title wording for Prop. 8 was biased, the committee promoting the measure said Monday it would seek no further legal action in the matter.
Prop. 8, if approved by the voters in November would amend the California Constitution to state that marriage was only between a man and a woman.
Supporters of the initiative argued that the attorney general's wording that the measure, that "...(Prop. 8) would "eliminates (the) right of same-sex couples to marry" was unfair to their cause.
"We have declined to further appeal this matter," Yes on 8 spokeswoman Jennifer Kerns told PolitickerCA.com. "We will leave it to the ultimate judge -- the voters -- on election day."
Brown initially titled the measure as a "Limit on Marriage" when it was being circulated for qualifying signatures.
But following the May California Supreme Court ruling stating that same-sex couples have a right to marry under the state constitution, Brown changed the title to its current and now final phrasing.

After throwing in the towel on this issue, it's going to be interesting to watch and see how they intend to continue the fight.
What was already an uphill battle just got ridiculously steep.
